Privacy policy

This privacy policy explains how we process the personal data of people who visit umobile.pl or contact us. We apply Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (the GDPR, in Polish: RODO) and the Polish Personal Data Protection Act of 10 May 2018. The Polish version of this policy is the binding one.

This policy covers the umobile.pl website only. It does not cover the advertising services we provide to clients and publishers, which are governed by separate agreements and documents.

1. Data controller

The controller of your personal data is UMOBILE Spółka z ograniczoną odpowiedzialnością, registered office: ul. Franciszka Klimczaka 10 a/5, 02-797 Warsaw, Poland, entered in the Register of Entrepreneurs of the National Court Register (KRS) kept by the District Court for the Capital City of Warsaw, XIII Commercial Division, under number 0000759144, tax ID (NIP) 5223142490, REGON 381881554, share capital PLN 5,000.00 (“we” or “the Controller”).

2. What data we process, why, and on what legal basis

a) Contacting us (e-mail, phone, WhatsApp, contact form)

The contact form on the website does not send data to our server. When you click the button, it opens your own e-mail app with a prepared message that you send yourself. When you write to us or call us, we process the data you provide: usually your name, e-mail address, phone number, company or website name, and the content of your message.

  • Purpose: replying to your enquiry and preparing an advertising campaign proposal or publisher partnership terms.
  • Legal basis: Art. 6(1)(b) GDPR (steps taken at your request before entering into a contract) and otherwise Art. 6(1)(f) GDPR (our legitimate interest in corresponding and communicating with clients and business partners).

b) Using the website (technical data)

When you view the website, the hosting provider’s servers automatically log technical data such as your IP address, the date and time of the request, browser and operating system type, and the referring page.

  • Purpose: keeping the website running, secure and available, including protection against attacks and abuse.
  • Legal basis: Art. 6(1)(f) GDPR (our legitimate interest).

c) Establishing, pursuing or defending claims

We may process data from correspondence to establish, pursue or defend possible legal claims, on the basis of Art. 6(1)(f) GDPR.

3. Cookies and analytics

umobile.pl does not use cookies, analytics tools or advertising pixels. We do not track your activity or profile you. The hosting provider may use technical mechanisms that are strictly necessary to keep the website secure.

The website loads fonts from Google Fonts. Your browser therefore connects to Google’s servers, which receive your IP address.

4. Recipients of data

Your data may be shared with providers that process it on our behalf under data processing agreements or their terms of service:

  • Netlify, Inc.: website hosting and delivery (CDN),
  • Google Ireland Limited / Google LLC: e-mail (Gmail) and fonts (Google Fonts),
  • WhatsApp Ireland Limited (Meta): if you contact us via WhatsApp,
  • accounting, legal and IT service providers, to the extent needed to provide those services.

Data may also be disclosed to public authorities where the law requires it.

5. Transfers outside the European Economic Area

Some of our providers (Netlify, Google, Meta) are based in, or use infrastructure in, the United States. Transfers to the US rely on the European Commission’s adequacy decision of 10 July 2023 under the EU-U.S. Data Privacy Framework (for certified companies) and otherwise on standard contractual clauses approved by the European Commission (Art. 46(2)(c) GDPR). 6. How long we keep data

  • Correspondence: for as long as needed to handle your enquiry and any talks that follow, and then until any possible claims become time-barred.
  • Technical data (server logs): for the retention period used by the hosting provider, usually no longer than a few weeks.
  • Data processed on the basis of legitimate interest: until you successfully object.

7. Your rights

You have the right to:

  • access your data and receive a copy of it (Art. 15 GDPR),
  • have your data rectified (Art. 16 GDPR),
  • have your data erased (Art. 17 GDPR),
  • restrict processing (Art. 18 GDPR),
  • data portability (Art. 20 GDPR),
  • object to processing based on legitimate interest (Art. 21 GDPR).

To exercise these rights, write to us at umobile.poland@gmail.com. You also have the right to lodge a complaint with the supervisory authority, the President of the Personal Data Protection Office (Prezes UODO, ul. Stawki 2, 00-193 Warsaw, uodo.gov.pl).

8. Providing data is voluntary

Providing your data is voluntary, but without it we cannot reply to your enquiry.

9. Automated decision-making

We do not make decisions about you based solely on automated processing, including profiling (Art. 22 GDPR).

10. Changes to this policy

We may update this policy, for example when the law or our services change. The current version is always available on this page together with the date of the last update.
